法律具有在社会主体间价值共识与认同基础上的社会信用性。法律信用既是法治运行系统中客观存在的基本要素,又是社会主体应当具备的一种主观心态与文化素质。法律信用在法治系统构成中占据基础性与决定性地位。考察与把握法律的社会信用性,有助于充分认识法的运行的内在结构,养成法律权威与法律信仰的法治观念,自觉进行法治实践活动,遵循法治的基本要求,在理念层次上保障法治实效的真正实现,促进社会生活和谐稳定与发展进步。 相似文献

法治建设是一个国家全面发展的重要标志和基础。在法治社会中,法律在权力约束和社会秩序维护方面发挥着重要的作用。作为法治社会的基石,法律教育具有极其重要的意义,尤其是大学生法律教育的主体建设路径。基于此,本文对法治建设视阈下大学生法律教育主体建设路径进行研究。在明晰法治建设与大学生法律教育的关系基础上,明确其在大学生法律教育主体建设路径中的重要性。通过研究大学生法律教育主体建设现状,指出现存挑战。通过构建多元化的教育主体体系、加强教师的专业素质培养、建立科学的教育评估机制的路径,为更好地适应和推动社会的法治化进程做出努力,从而推动整个社会的法治建设进程。 相似文献

现代法治自身存在着诸多的矛盾 :形式法治要求的恪守法律规则、严守审判程序与立法机关的多元主体、司法权的行政分割之间的矛盾 ;现代法治的民意体现与法律成为权力执掌者自上而下施加的社会控制工具的矛盾 ;法律规则的确定性与现实境况的多样性之间的矛盾 ;法律的普遍适用性和人们之间差异性之间的矛盾 ;法律的一般规则与千差万别的事实之间的矛盾。缓解这些矛盾 ,可从现代法治之外着眼考虑 ,即在重视效率价值的同时 ,重视社会公平价值 ;在保护市场经济自由竞争同时 ,重视对弱势群体的扶持 ;重视政府权力的人民性建设 ,扩大社会自治的范围等方面做一些思考。 相似文献
