WTO争端解决机制具有高效、安全可靠的特点，其争端解决机构对成员国之间发生的与贸易有关的争端具有排他性的强制管辖权；多边环境协定争端处理机制的特点是争端解决方式具有选择性，其裁决结果大多数情况下并不对缔约国产生约束力。两机制对环境贸易措施的适用所引发的争端都有合法管辖权，实践中可能会出现两机制对同一争端双重管辖、被相同的当事人同时启动，裁决结果却大相径庭的窘境。为协调好两机制之间的关系，应提高“斡旋、调解和调停”等WTO非正式争端解决方法的使用效率；加强WTO争端解决机构在有关的争端解决程序中对多边环境协定争端处理机制的尊重与支持；同时，应在WTO框架内设立环境咨询委员会。 相似文献

WTO协定是对其所有的成员国具有拘束力的国际法。它要求其成员建立符合其规定的司法审查制度。对于WTO协定在我国行政诉讼的法律适用，应在维护我国国家主权和经济利益的同时又参照各国通行的做法，采用混合适用的方式。若WTO规则与国内法规定发生冲突，应优先适用WTO规则。同时，还应适当参照或援引WTO争端解决机构通过的专家组决定和上诉机构的裁决。 相似文献

美国是全世界在对外贸易领域里管制最严密的国家,美国使用的贸易法"301条款"授权美国贸易代表可以采取单边制裁行动,其本质是攻击性单边主义。WTO禁止成员针对其他成员违反《WTO协议》规定的义务而导致利益丧失或减损行为采取单边行动,要求成员之间使用WTO争端解决程序来处理多边主义机制解决有关的争端。单边主义广受诟病,多边主义美好却执行力差,两者如果能按原则与例外的方式互动援引,则可以弥补单一适用的缺陷。 相似文献

美国是全世界对对外贸易关系管制得最严密、最强烈的一个国家，美国贸易法“301条款”是一项“报复性”的法律。其本质是攻击性单边主义，即301争款授权美国贸易代表可以采取单边制裁行动；而WTO作为多边贸易体制的组织，其争端解决机制采用的是多边主义，即它禁止WTO成员针对其认为违反义务或导致《WTO协议》规定的任何利益丧失或减损而采取单边行动，要求成员使用WTO争端解决程序来解决与这些问题有关的争端。作为WTO的成员国，并且对WTO争端解决机制作出重大贡献的美国，何以违反WTO使用“301条款”？我们认为，其基于的唯一原则是：美国利益至上。 相似文献

WTO的争端解决机制是一个具有司法性质的争端解决机制，为WTO框架下的多边协议的贯彻执行提供了强有力的保障。由于WTO已经将投资问题纳入其调节范畴，WTO法律框架下的一系列协议都直接或间接地与国际投资相关联，且产生与这些协议的争议都须适用WTO争端解决机制来解决，因此，WTO争端解决机制事实上为投资争议的多边解决提供了新的机遇，它可以弥补一系列传统投资争议解决方法的不足，推动投资争议解决的“非政治化”，确保投资争议解决的公平和公正。 相似文献
