The degree to which agreements between authors and publishers are left to free negotiation varies from country to country. As the European nations move toward economic unity, a greater degree of conformity in literary common law is desirable. Any common rules on publishing contracts should balance the interests of publishers and authors so that authors receive a fair share of all exploitations of their work and publishers are free to exploit the works in all possible ways. Exploitation includes both traditional means and new mass media and merchandising rights. professor of Intellectual Property and Copyright Law at both Berlin state universities, and author of commentaries on the German Copyright Code (7th ed., 1988), the German Unfair Competition law (6th ed., 1990), and the International Copyright Conventions (German ed., 1977; French ed., 1982; English ed., 1990). This article was adapted from a presentation at the seminar “East Meets West: Copyright and the Publisher in a Market Economy”, Hamburg, March 1991.  相似文献

A total of 966 allegedly ‘predatory’ open access publishers were examined to determine the nature of their ethical or unethical practices and the extent to which Australian academics were included on the editorial boards of their journals. An estimated 4,000 Australian academics (ca. 7% of the academic population) are on these journal boards. Of the publishers, 240 proved to be overtly fraudulent, the ethical status of the others remaining unresolved. About 86% of the Australian academics identified appeared on the editorial boards of journals belonging to those 240 publishers. Despite two decades of advocacy from librarians, there remains widespread ignorance of the existence of such fraudulent publishers, and more severe action is required. Reform proposals include naming the publisher in all references and in academic profiles and curriculum vitae. Universities are encouraged to take responsibility for publishing journals that replace those currently causing the problem. Institutions are urged to augment their current warnings and advice with formal policies, which will probably require a blacklist of unacceptable publishers. New formal policies for dealing with predatory publishers are currently being developed in some Australian universities.  相似文献

In this short article, Henry Rosenbloom, the founder of Australian independent publisher Scribe, complains about the tactic of UK-based publishers buying ‘Commonwealth’ rights and preventing Australian publishers from acquiring separate Australian rights. ‘UK publishers are not entitled to Australia as a territory. It is our country, our market, and our industry,’ he writes. This article was originally published in The Age newspaper in early 2008, then on Rosenbloom’s blog, and it was the catalyst for a spirited debate at this year’s London Book Fair.  相似文献

In this article, Andrew Wilkins, the former publisher of bookseller+publisher magazine, provides an annual overview of the Australian book marketplace, offering statistics on the market and analysis of the key publishers, retailers and consumer habits. The second half of the article concentrates on international rights sales, an important aspect of the Australian publishing industry. This article was originally published in 2007 as part of the annual Think Australian magazine, which aims to support Australian publishers and literary agents at the Frankfurt Book Fair (see ).  相似文献

The author explores the structure of the Australian news paper industry and regulations governing ownership. He then examines the 1992 report of the government inquiry into the newspaper industry, which acknowledged that the basic cause of newspaper concentration lies in the economic nature of the industry and agreed that current concentration in the Australian press is excessive. The author argues, however, that recommendations of the government inquiry are unlikely to increase diversity of ownership or prevent future takeovers of the remaining papers not owned by the nation's two major publishers.  相似文献

In this article, we summarize the cost implications of print and electronic publishing for scientific scholarly journal publishers, libraries, and scientists. In each case, we developed detailed cost models to demonstrate the importance of factors that affect publishing and decisions made by libraries and scientists to determine whether to subscribe to a journal; if so, in print or electronic medium, and, if not, what alternative information sources to use. In all instances, estimates of unit cost are essential for understanding the dynamics of the economic and systemic interdependencies of publishers, libraries, and readers.  相似文献

This paper analyzes how technological change and digitalization in the Spanish publishing sector is challenging existing business models and encouraging publishers to modify their portfolios of products and competencies. A qualitative analysis (case study) of three Spanish publishers is carried out. The practical implications of the research are that digital products and services are still considered secondary to the analog book. On the other hand, the proportion of titles available in digital formats is still small. To all this, the lack of a common dominant design for digital publication is added, which represents an uncertainty for editors, to which must be added the lack of institutional support. For the time being, Spanish publishers are simply selling digital versions of their paper books on digital distribution platforms, trying to minimize risks by betting on positively contrasted works in the traditional paper-based business model.  相似文献

This interpretive study of change in Australian book publishing, included a survey of book publishers and the conduct of 14 case studies in five categories of publisher: general trade, academic, professional, specialist and university. This paper reports in detail on the experience on one general trade publisher as it sought to face the challenges of globalization and of organizational and technological change. The major finding was that digitization is indeed, impacting on business models for book publishing, with current models comprising something of a hybrid between the traditional and the innovative. Reflecting the presence in Australia of similar trends and issues that are affecting book publishing around the world, the findings are of relevance both to book publishers and to researchers. The work is original in that relatively little recent academic research has been conducted into book publishing in Australia, particularly as regards the implications of digitization for business models.  相似文献

This paper is based on an Australian government-funded research project looking at the implications of digitization for the book publishing industry, which was originally completed in 2008 and later extended to cover up to the present day. Although Australian-based the project and subsequent research has wider implications for application elsewhere. The paper initially provides a snapshot of Australian book publishing in a global context, and then summarizes our findings on the current and potential future impact of digital technologies. The original research employed an interpretive research paradigm, using a mixed methodology design, including an online survey of book publishers and the conduct of 14 case studies. The extension of the original research project led to its being given a more global dimension. In reporting this new research, the paper discusses in detail the diverse range of technologies, their limitations and the risks and opportunities they offer to the book publishing industry. This includes insights into the business as well as technical issues confronting the industry.  相似文献

The former Director of the Frankfurt Book Fair presents a concise history of what today is the largest international book fair including the key publishers, booksellers and authors who are part of the amazing global event. The interesting initial development and challenges of post World War II and related relocated German publishers are described. The initial efforts as a national book fair from 1949 to the present international event are traced. The turmoil and confrontation of political groups during the 1968 and subsequent years with actions taken was a difficult period for the fair but it survived to grow into a global event.  相似文献

The literature on evolving economic models in the electronic publishing industry of academic and scholarly communication has primarily been based on an ideology of economic efficiency. This ideology implies the role of print journals and publishers will become less dominant in the publishing industry since market forces predict a significant change in the flow of incentives and information between the various stakeholders. However, recent research suggests that this conclusion may be premature. Resisting forces, which manifest themselves via institutional, infrastructural and informational channels, seem strong enough to maintain the viability of print publishing in the medium term.  相似文献

Until 50 years ago the purpose of publishers in Australia was to act as distributors for overseas companies, mainly British. From 1970 onwards a local publishing industry began to develop, taking advantage of the greatly increased investment by publishers in distribution systems to service the “closed market.” In 1991 the “30-day rule” was introduced, leading to an increased amount of local printing of overseas titles, and a growing number of rights purchases of overseas-published books. The pros and cons of “separating out” Australian rights are addressed in this paper.  相似文献

In her report about the German publishing industry in 2010, Veronika Licher shows some of the trends and different stages of digital development. She mentions how different players like the German Publishers and Booksellers Association or book wholesalers changed direction or added new services to adapt to the changing market and how e-book distribution is working its way through traditional and new channels. A short review of the bestselling titles in 2010 and the development in children’s publishing follows as well as an introduction how German publishers are trying to make use of the new reading pens.  相似文献

SUMMARY

The three presentations in this session provide an introduction to the economic challenges faced by small scholarly publishers. The first talk reviews trends in the library market and publishing trends of increased monopolization; the second describes the demands of technological innovation; and the final talk presents a budgetary case study from a medium-sized society publisher evaluating the impact of dropping the production of print journals. After the three talks, a list of eight recommendations for alleviating the pressure on small publishers was presented for audience discussion. The three speakers are all active in the Society for Scholarly Publishing (SSP) and invite a closer collaboration with NASIG. Kasdorf is a Past President and Ivins and Seitter are Board members. All three are committee chairs or co-chairs.

The book market is one of the last media markets affected by digitization, so the question is whether this market follows the same patterns as other media industries before. Our study analyses if these digitization processes lead to a stronger market orientation thus commercialization of a market that traditionally has been understood as a market of cultural goods. We conduct a market analysis and a survey among authors, publishers and booksellers in Germany and Switzerland to answer this question. Our findings support the notion of an increased market orientation among publishers and booksellers. However, the tendencies towards commercialization cannot be attributed to digitization alone but might happen even without it.  相似文献
