环境刑事立法中的危险犯是指行为人实施了环境污染和破坏行为,对环境、财产造成了间接危害,或对公众生命与健康构成了威胁,并可能造成更严重的后果。之所以要在我国刑法中设立环境犯罪的危险犯,是因为其具有三个方面的立法价值,这三方面分别为：从环境刑法保护的客体特征为角度,从环境刑法的体系完善为角度,和从环境刑法的功能增强为角度。环境犯罪侵犯的客体因其重要性和不可恢复性需要设立危险犯进行特殊保护。设立环境危险犯还有助于对环境刑法中过失犯局限性之弥补。并且,对环境刑法的功能是一种极大的增强。 相似文献

我国现行的污染环境犯罪立法对污染环境犯罪的犯罪形态规定不科学、主观罪错规定不明确、法定刑规定不合理以及附属刑事法律规范不健全.因此,应当在污染环境犯罪刑事立法中确立环境保护理念,构建以危险犯为基本犯罪形态的污染环境犯罪体系,明确污染环境罪的主观罪错内容,建立合理的刑事处罚制度,健全污染环境犯罪的附属刑事法律规范,最终实现我国污染环境犯罪的立法完善. 相似文献

风险社会与转型时期的不期而遇,我国重实害的传统危险犯立法无法反映风险社会某些危害行为的特征,因为其不注重个体安全的预防,进而不能有效抑制犯罪。在新的社会背景下,我国危险犯立法应当肩负维护社会道德底线、唤起民众的规范意识、加强犯罪预防的重要责任。新时期,我国危险犯立法应贯彻以人为本的社会理念,加大立法的拟制性,扩张危险犯的范围,通过转化危险犯的立法范式以预防犯罪。刑事立法应设置新的危险犯类型,并将一些具体危险犯转化为抽象危险犯。 相似文献

危险犯是指把对法益的侵害危险作为处罚根据的犯罪。环境犯罪中的危险犯不要求出现特定的实质损害后果,只要造成某种危险状态就可成立。目前,环境犯罪存在危害潜伏期较长、阻碍经济发展、修复难等问题。解决之道应是借鉴国外有效经验,明确环境犯罪的客体,设立环境犯罪危险犯以及增设单位危险犯等。 相似文献

危险驾驶行为入罪弥补了我国现行刑事立法的不足,但还存在危险驾驶表述不严谨,缺乏实害犯的量刑幅度,刑罚过于轻缓、实践操作性不强等不足之处。因此,对危险驾驶罪予以完善就成为司法实践的需要。如应进一步界定危险驾驶行为的范围和种类、细化危险驾驶入罪的标准,适当增加危险驾驶的处罚力度和共犯规定等。 相似文献

环境犯罪的特点是污染容易而恢复和治理极难。它不仅涉及范围广、持续时间长,而且有些情形下造成的后果常常是不可逆转的。环境保护的基本原则应当体现在重预防,防止危害环境结果的发生方面。如果环境立法只注意惩罚造成实害结果的环境犯罪,忽略了对环境污染造成严重危险状态行为的处罚,那不仅是对行为主体的放纵,也极不利于对环境的保护,因此,有必要在污染环境罪中设置具体危险犯。 相似文献
