The increased patenting activity of foreign nationals in the United States has been a source of recent concern, and the fear has been expressed that the US is becoming relatively less technologically inventive. This paper investigates some possible causes of the increased foreign patenting activity and also briefly examines the determinants of patent filings by a country's own residents. The countries covered include: Canada, France, West Germany, Japan, the Netherlands, Sweden, Switzerland, the United Kingdom, and the United States.Based on data on patent applications filed and some preliminary regression analysis, the paper finds that the rising foreign patenting activity in the US probably does not reflect increased foreign inventiveness vis-à-vis the US. However, foreign innovativeness may be increasing relative to the US. Over the period 1963 – 1974, the domestic patent base, measured by the number of patent applications filed by nationals in their home countries, has shown little change in any country except for Japan. Rather, multiple patent applications and a greater propensity to patent abroad, induced by the possibilities of exporting, appear to be the sources of the increase in foreign patent applications in the US and also in Japan.  相似文献

This study investigates empirically whether patents can be signals to financial markets, thus reducing problems of asymmetric information. In particular we study how patenting behaviour impacts on the way investors perceive software firms’ growth potential through an increase in the amount invested at the initial public offering (IPO) of firms in the US and Europe. This study performs regressions on the relationship of patent applications before IPO and the amount of money collected at the IPO, while controlling other factors that may influence IPO performance. We also attempt to account for a potential source of endogeneity problems that can arise for self-selection bias and simultaneity between the number of patent applications prior to going public and the amount of money collected at IPO. We find significant and robust positive correlations between patent applications and IPO performance. The signalling power of patenting is significantly different for US and European companies, and is related to the difficulty in obtaining a signal and its scarcity. An additional patent application prior to IPO increases IPO proceeds by about 0.507% and 1.13% for US and European companies, respectively. Results suggest that a less ‘applicant friendly’ patenting system increases the credibility of patents as signals and their value for IPO investors.  相似文献

This paper compares and contrasts the invention patents of the US and China focusing on the application and granting practices. The findings show that both countries appear to make efforts to provide equal treatment to domestic and foreign applicants for patents in terms of pendency, but domestic applicants seem to enjoy more certainty of the patent being granted within the pendency period than foreign applicants in both countries. As regards grants, the US is equal in granting patents to domestic and foreign applications; China appears to give preferential treatment to domestic applications. Such practices have implications for both patenting policy and activities.  相似文献

A new comprehensive patent database based on patent applications filed with the Japanese Patent Office is described. We present the methodology for the construction of this database, the IIP Patent Database, its basic features and we discuss the recent history of patenting in Japan. We also compare citing-cited patterns of Japanese patents in this database with the citing-cited patterns for the same patents registered in the US, using OECD patent family information to identify US counterparts. We found similar patterns in the two countries, although citation is provided by patent examiners in Japan, while in the US a large share of citations is made by inventors.  相似文献

This article develops a general framework to describe the changes in university IPR regulations in Europe and their effects on the patenting activities of universities and on knowledge transfer processes. Understanding the effects of changes in IPR regulations on academic patenting is a complex issue, and parallels with the US case can be misleading. First, despite the general trend towards institutional ownership, university IPR regulations in Europe remain extremely differentiated and there is no one-to-one mapping to the US system. Second, it is difficult to disentangle the quantitative and qualitative effects of changes in IPR ownership regulations on academic patenting activities from the effects of concurrent transformations in the institutional, cultural and organizational landscape surrounding academic knowledge transfer. The article proposes a review and typological classification of national university IPR ownership systems on the basis of their development since 2000, and uses it to analyze the aggregate dynamics of academic patent ownership in several European countries. The analysis of patterns of ownership of academic patents shows that there has been a general increase in university patenting since 1990, with a significant slowdown (and even reduction in some countries) after early 2000s accompanied by a switch in academic patents ownership in favor of university ownership though preserving the European specificity of high company ownership of academic invented patents.  相似文献

Against the background of the patent upsurge, we first analyse the role of patenting and alternative instruments to protect intellectual property, based on a sample of German companies active in patenting. In a second step, we investigate the motives to patent, considering sector and company size effects. We find that company size matters, both for the importance of instruments and the motives to patent. Especially important are the new strategic motives to patent, like using patents to improve a company's own position in negotiations with partners, licensees and the financial sector, or to use patents as incentives for R&D personnel or performance indicators—these correlate positively with company size. We derive some possible challenges for future patent policies from these insights.  相似文献

This paper provides an empirical investigation of the national determinants of outbound international patenting, particularly focusing on the roles of trade-related influences and the destination countries’ strength of intellectual property protection. Based on cross-patenting from 30 member countries in the World Intellectual Property Organization (WIPO) between 1995 and 1998, empirical results suggest that the behavior of outbound international patenting is strongly and positively associated with trade-related influences, like exports and outward foreign direct investments. Moreover, controlling for other variables, a country with stronger protection of intellectual property rights (IPR) tends to force more foreign inventors to file for patent applications, lending a supportive view of cross-country evidence for the strong-IPR hypothesis.  相似文献

We analyze the impact of accession to the regional patent system established by the European Patent Convention (EPC) on 14 countries that acceded between 2000 and 2008. We look at changes in patenting behavior by domestic and foreign applicants at the national patent offices and the European Patent Office (EPO). We find a strong change in patent filing behavior among foreigners seeking patent protection in the accession states, substituting EPO patents for domestic patents immediately. However, there is no discernible reaction among domestic entities in terms of domestic filings, although we do find some evidence that applicants in accession states increased their propensity to file patents with the EPO post-accession. Inventors in accession countries also increase their patent filings slightly post-accession, both at the EPO and at the national offices.  相似文献

Like the US before it, Japan has adopted a series of policy initiatives designed to encourage the commercialization of academic science. However, such initiatives may also adversely affect “open-science”. Based on matched surveys of almost 1000 researchers in Japan and over 800 in the US, the paper examines rates of commercial activity, reasons to patent, and secrecy related to research results. In particular, it examines the extent to which participation in commercial activity is associated with publication secrecy. The results show that patenting rates are higher in Japan, while industry funding is more common in the US. In addition, the overall level of publication secrecy is greater in Japan. And, in both countries, individuals who are commercially active are less likely to share their research results through publication. But, patents are less directly linked to commercial activity in Japan than in the US, and have less impact on academic secrecy. The results suggest that academic entrepreneurship is associated with reduced participation in open science, but that the extent of adverse effects depends significantly on institutional context.  相似文献

We explore the effect of political uncertainty on innovation. In particular, we examine the differential effects of two sources of uncertainty – leaders’ education levels and political regimes (i.e., presidential vs. parliamentary) – on patent applications. We posit that firms react to political uncertainty caused by the unexpected departure of a national leader by investing in patents as growth options. The empirical design analyzes a panel with information from over 62 million patent applications at the aggregated applicant level. Results show that leaders’ unexpected departures cause, on average, increases of approximately 9% in the aggregate growth of patent applications. We also find that the leader’s level of education and the country’s political regime system have significant effects on the relationship between political uncertainty and innovation. The difference between leaders with high and low levels of education accounts for 21% of the change in the growth of patent applications. Further, the effect of political uncertainty on innovation is amplified in presidential systems, which grant leaders more power and make electoral transitions less predictable. The differences between presidential and parliamentary systems account for approximately 16% of the change in the growth of patent applications. As a robustness check, we utilized a subsample of more than 170,000 firms with local and foreign patent applications, as well as a panel of over 5700 government non-profits, universities, and hospitals with local patent applications. Consistent with our theory, the former react to political uncertainty by investing in patents, while the latter remain unaffected. We contribute by showing the theoretical mechanisms linking leader and regime characteristics with patent applications.  相似文献

This paper examines a number of forces that have possibly contributed to the explosive growth of Chinese patenting over the past decade. After a review of previous hypotheses and conventional wisdom, this study proposes an additional explanation and argues that patent subsidy programs implemented by each provincial region have played an important role in the growth of Chinese patenting. This institutional change, taking place at the province-level, has induced an increase in patent propensity among not only firms, universities, and research institutes, but also individuals. Empirical evidence based on publicly available data provides solid support for this argument. It was also found that a larger fraction of applications are granted patent rights since the implementation of such programs, suggesting that reduction in patent application quality may not be a serious concern, unless the criteria used for patent examination have been lowered.  相似文献

This paper addresses the question of whether patent citations are useful indicators of technology flows. We exploit the distinction between citations added by inventors and patent examiners. We use information from the search reports of European Patent Office patent examiners to construct our dataset of patenting activity in Europe and the US, and apply various econometric models to investigate what determines the probability that a citation is added by the inventor rather than the examiner. Contrary to previous work which uses US Patent and Trademark Office data, we find that geographical distance is a factor that strongly diminishes the probability of knowledge flows. We find other significant effects of such factors as cognitive distance, time and strategic factors on citing behaviour.  相似文献

In the presence of asymmetric information, economic agents need to communicate their quality to investors and other parties. This paper investigates how information generated during the patenting process affects the ability of new ventures to attract VC financing. While much of the literature on information asymmetries focuses on patent applications, we argue that the entire examination process should be considered, including information that emerges in the course of patent examination and review. We test several hypotheses using a sample of British and German companies that seek venture capital. We find that the filing of patent applications is positively related to VC financing. Moreover, the examination process at the patent office generates valuable technological and commercial information via search reports, citations and opposition procedures which affect the likelihood of VC financing. Our results suggest that the patenting process supports investors in updating their expectations regarding the quality of new ventures.  相似文献

Foreign patenting in the U.S. has been considered to be a useful technology indicator in comparisons between countries. In order to shed light on this topic, this paper will try to explain foreign patenting in the U.S. by way of data for one country - Norway.A crucial question is what role is played by exports in explaining the foreign patent activity. Is the U.S. patenting just an indicator of the export performance, or is it the other way around; that technology - measured by foreign patent activity - is an important trade explanatory variable.The first part of this paper deals with the relationship between Norwegian U.S. patenting and export to the U.S. by way of time-series analysis on data from 1883 to 1980. Then some more detailed analysis are done on industry-level data from 1920 and from 1960–1980. An hypothesis is further tested for the possible relationship between foreign U.S. patenting and the international business-cycles. Finally a detailed but tentative analysis is done on firm-level data for the years 1969–1980.The results lend partial support to the assumption that foreign U.S. patent activity reflects innovative activity in the country where the patents originated. A major advantage in using foreign patenting in the U.S. as a technology indicator, is that this type of data in general seems to be of a higher quality than domestic patent data.  相似文献

We propose an empirical strategy to estimate competition in innovation markets. Our method relates firms’ market return on equity to information about patent citation patterns. Two innovations are implemented in the methodology. First is the application of daily abnormal stock returns rather than annual measures of Tobin's q. Second is the creation of citation patterns related to the area of science a firm patents in as represented by the detailed patent classification system. We find that markets positively reward firms when patents are granted. We further find that firm's market value increases when its patent portfolio is cited. We find evidence of competition in innovation markets. The market reacts at the time that the citation occurs and does not anticipate future citations at the time of patenting. Holding this effect constant, we find that citations from patents in the same area of science tend to reduce market value. We interpret these findings as consistent with more citations indicating more valuable intellectual property but citations from competing technologies decreasing it.  相似文献

The implementation of a Bayh-Dole-like legislation outside the US is still a major concern that needs to be addressed. I fill this gap in two ways. First, I report the results of a faculty survey on obstacles to patenting activity in Italian universities, targeted both to inventors and to those non-inventors which reported to engage in university patenting activity and to give up before any patents could be filed. Second, I investigate their effect in a regression model using universities’ patent counts as the dependent variable. Results show that obstacles to university patenting activity reduce to four dimensions: lack of support mechanisms (including insufficient reward for researchers, lack of a TTO, lack of funds to cover patenting costs), commercialisation problems, too heavy teaching and administrative duties, and personal/cultural problems (related to the scarce knowledge of institutional-level patent regulations and to the “open science” mentality of the university). Among them, however, only the lack of support by the university administration reduces the patent counts. Publication productivity has an inverted U-shaped relation with patent counts, but the overall effect is still largely positive, given the current publication levels.  相似文献

We examine the diversification of administrative and procedural costs on patent stock using a large dataset from the European Patent Office with 15,000 firms for the period between 1995 and 2015. The results reveal that administrative and procedural costs are significant for firm-level patenting activity. However, not all administrative and procedural costs have equal effects. Higher administrative costs often encourage patent application and validation by solving the adverse selection problem and short-run opportunism, as well as other sources of asymmetric information. The effective administration of intellectual property law and low-cost enforcement are found to considerably foster patenting activity. The effects are robust for various mis-specification checks and do not disappear once country-level research and development infrastructure proxies are controlled for. The extreme bounds of administrative and procedural costs are computed across more than 5 billion regressions, and the sizeable impact of administration on patent application and validation outcomes is confirmed.  相似文献

    文章结合中国专利行政管理的体制机制和中国式分权背景,剖析了省级地区间专利行政保护策略互动的形成逻辑,并采用一般空间计量模型(SARAR)对省级地区间专利行政保护策略互动的类型进行了识别。结果发现:(1)在中国式分权背景下,受制于资源流动约束,以及受自上而下的经济和政治压力的驱动,地方政府和地方政府官员会竞相提高本地区的专利行政执法力度,形成了相互模仿的地区间专利行政执法策略互动;(2)基于2002—2016年中国省级面板数据的估计结果显示,在地区专利行政保护方面我国地方政府间的确存在相互模仿的策略互动,相邻地区间的专利行政保护能够相互促进。  相似文献

Drawing on the resource-based view of the firm, we examine the effect of technological competition over a patent on the firm's choice of patenting strategy. We claim that technological competition makes the traditional strategy of protecting focal innovations from imitation less likely and increases the likelihood of a play strategy — i.e. using patents to avoid the risk of hold-up by other patent owners, or as a bargaining chip in litigation and cross-licensing. However, we claim also that technological competition over a target close to the firm's core technology should lead to use of a fence strategy i.e. to blocking the commercial endeavors of rivals and preempting substitute inventions. We find support for our hypotheses using data from a large-scale survey of European patent applications.  相似文献
