论留置物的性质对留置权善意取得的影响 总被引：1，自引：0，他引：1
国内外立法实践中,多数国家的法律均将留置物的范围由债务人的财产扩大到了他人财产。然而我国学界一般将其误认为是留置权善意取得的立法例,并未认识到其作为留置权成立条件的真正内涵。留置权的善意取得,主要应取决于留置物性质。当留置物为占有委托物时,留置权的取得不宜适用善意取得制度,留置权应依担保法一般规定成立;当留置物为占有脱离物时,若债权人为善意,留置权的取得应适用善意取得制度。 相似文献

《物权法》设立和明确了一些重要的物权法律制度,其中对于留置权法律制度,《物权法》改变以往的法定原则,扩大了留置权的适用范围,建立了商事留置权制度,明确了留置权优先于抵押权和质权的原则,这对保证经济生活中债权的实现具有重要意义。但是,对留置权是否应受某种限制这一问题,学界一直存有很大的争议。因此,有必要结合国外立法对留置权限制的相关规定,从我国《物权法》和《担保法》出发,从留置权的设定、标的物的限制等方面对留置权成立的限制及其相关问题进行研究和分析,并结合实务对留置权限制的操作规则进行说明。 相似文献

From synchronic aspect, the social and cultural influence on word meaning is mainly embodied in conceptual and associative meanings of word. The incorrespondence of word meaning is a phenomenon that exists in both conceptual and associative meanings of word among different languages. From diachronic aspect, the development of social culture causes some changes of word meaning to some extent.
