Using a sample of Supreme Court Justice William O. Douglas' Supreme Court opinons as the data base, this study investigated the question of whether majority or non‐majority status constitutes a variable sufficiently strong to predict the rhetorical quality of the opinion. The three traditional schools of legal philosophy, Natural Law, Legal Positivism, and Legal Realism, provided the basis of three hypothetical rhetorical genres which were found to be present in statistically similar frequencies in all opinion types. These findings (1) call into question the conventional wisdom that majority and dissenting opinions represent different rhetorical sub‐species, and (2) suggest that a more fruitful avenue of analysis looks to the generic architechtonics of Supreme Court opinions rather than to the relatively more superficial dimension of stylistics.  相似文献

This commentary argues that Indvik and Fitzpatrick's article, “Perceptions of Inclusion, Affiliation, and Control in Five Interpersonal Relationships,” presents an inappropriate conceptual and methodological approach to the study of relationship defining communication. Problems are most evident in: (1) the domain isolated to represent the themes of inclusion, control, and affection; and (2) the inattention to the interdependence established with communication between relationship partners.  相似文献

Teacher professionalization is a recent field of study in France that has developed in connection with the creation of the Instituts Universitaires de Formation des Maîtres (IUFMs) and other changes that have brought primary and secondary teachers into closer relation. In order to help the reader understand the traditional divisions between these two groups and recent trends towards unification, we first present historical differences in their development as separate corps, their training and their modes of unionization. We then proceed to analyse the political turning point of 1989, date of the creation of the IUFMs which introduced a similar curriculum for teachers of each degree on the basis of officially specified fundamental skills, as well as leading to the reconstitution of teachers' unions. Finally, we examine the effects of recent moves toward professionalization on the rationalization of teachers' knowledge and skills, the relationship between training and professional activity and teachers' socialization.  相似文献

The overlap of words specifically taught in reading textbooks with the contents of standardized reading achievement tests may be a source of bias that is frequently overlooked in psychoeducational assessments. This study compares the standardized achievement test performance of 62 second graders receiving instruction in two different reading curricula (Open Court and Houghton-Mifflin) to determine whether either curriculum generates different quantitative estimates of reading achievement. Reading subtest scores derived from the Kaufman Test of Educational Achievement-Brief Form (K-TEA), the Wide Range Achievement Test-Revised (WRAT-R), and the Reading Recognition and Reading Comprehension subtests from the Peabody Individual Achievement Test (PIAT) were examined. Grade level equivalents and scaled scores from the California Achievement Test (CAT) were also examined. Three Curriculum × Test repeated measures ANOVAs were conducted using grade level scores (2×7), standard scores (2×4), and CAT scaled scores (2 × 5) as dependent measures. A significant Curriculum × Test interaction was identified, suggesting differences among tests in estimates of reading ability as a function of the reading program.  相似文献

Memory tests, such as the Learning Efficiency Test-II (LET-II), have frequently been used to describe the memory characteristics of special populations such as persons with learning disabilities, brain damage, or Alzheimer's disease. Yet, few research studies have examined the memory characteristics of normally functioning children and compared these characteristics to their performance on ability tests or real-life achievement criteria. This study investigates the predictive and concurrent validities of the LET-II for performance on the Kuhlmann-Anderson Tests (K-A), class grades, and actual grade level functioning in reading and mathematics for third and fourth grade children of average intelligence. The LET-II memory factor scores correlated significantly with the K-A scores, class grades and actual grade level functioning in reading. The relevance of these findings for norm-referenced psychological tests, and in particular memory tests, in real-life settings is examined. © 1996 John Wiley & Sons, Inc.  相似文献

This study examines the temporal stability of the WISC-R for 155 13-and 14-year-old adolescents identified as either EMR or LD who were involved in special education during the preceding three-year time period. The three major scales of the WISC-R were found to be more stable over a three-year period for the LD than for the EMR group, while the subtest scales for the EMR group, showed greater stability over the three-year interval. Test-retest coefficients for the EMR group were substantially lower than those presented in the WISC-R test manual. A large proportion of individuals within both groups showed statistically significant differences on one or more of the IQ score scales between testings based on standard errors of measurement. These findings are examined in relation to individual placement of students, reporting confidence intervals in reports, and calculation of the best unbiased estimate of intellectual functioning.  相似文献

Condition 1 showed that employees recorded high percentages of completed tasks; and task performance was shown to slightly improve. At that point in the project, recording accuracy was at it's highest level. Condition 2 illustrated a continuance of high employee records of completed tasks but also showed that actual task performance considerably increased so that there was greater self-recording accuracy. Then, during Condition 3, actual task performance increased more so that it even more closely reflected self-recorded measures. Each of the steps discussed thus far could be sufficient individually to facilitate accurate self-recording and task performance gains, although each appeared to have gained additional strength by being collectively applied. The cost of the present organizational intervention was very low. The costs included material duplication costs and approximately 30 minutes of management time per day. Management time was used to make concession observations (management records), compute performance data, and provide feedback to the employee. Employees worked the same number of hours as in Baseline. Based on this breakdown, the approximate weekly cost of this project was about $30.00. The total cost could be reduced further, perhaps, by monitoring less frequently and reducing the frequency of feedback sessions as employee performance stabilized at higher levels. Thus, the longer this project would run, the less expensive it might become. The steps implemented during this project might easily be applied to other jobs that produce easily observable outputs and could also be applied to other work settings. Future research efforts that would identify cost-effective ways to stimulate and maintain high levels of accurate self-recording might provide today's managers several options that could all yield accurate data for organizational management. Other research efforts centered on specific analyses of participatory standard setting, peer reinforcement, and self-reinforcement for task performance could provide additional insight into the areas of job analysis and employee productivity. Lastly, increased knowledge about the long term effects of self-recording could be gained through future research methods that first established high recording accuracies and task performance levels, then evaluated maintenance procedures for these methods. Implications of successive research studies which clearly show that employee performance can be improved by rewarding performers for accurate self-recording could be profound.  相似文献

Patterns of verbal communications between a teacher and student can influence the classroom environment, quality of the instructional program, and student management in the classroom. This study examined teacher-student communication patterns in both regular and special education classes for behaviorally and emotionally handicapped students. It was expected that special class communication patterns would differ substantially from those used in regular classes. Those communications would result in more effective student management and more time on-task for learning. Webster's (1984, 1986) Process Interaction Model was used to analyze the communication patterns. Expected differences between how regular and special class teachers interact with students were not found. Implications of findings are discussed in relationship to teacher training, teacher effectiveness, and classroom management.  相似文献
