网络教唆行为入罪之必要性探讨

网络教唆作为一种新型的犯罪形式,与传统教唆相比,不仅是表现形式的改变,而且有了性质上的不同。其特点主要表现为:教唆故意的复杂性,教唆形式的多样性,教唆内容传播的广泛性和教唆对象的不特定性,以及由此带来的对教唆行为认定上因果关系的不确定性。由于网络教唆的上述特点,在其主观故意、客观行为以及教唆对象等方面,都出现了传统理论并不能很好解释的新问题。而事实上网络带给社会生活与法律理论的冲击已经不可避免。由此,在刑法中单独确认该行为的外延和内涵,应该是解决问题的根本之道。  相似文献

近年来,中国生物医学研究快速发展的同时,也在伦理治理方面带来了挑战。贺建奎公开声称其胚胎基因编辑婴儿诞生后,立即招致广泛的批评、谴责和激烈的伦理和法律大辩论。以生育为目的的胚胎基因编辑操作违反了公认的伦理规范,具体包括:较低的科学价值、不合理的风险-受益比、伦理审查不合规、并非真正的知情同意等。这说明主要依靠科研人员自律的机构伦理治理体系是成问题的,为此需要在不同层面上改进伦理治理水平,强化技术和伦理指南和法规。  相似文献   

“Hispanic” children: Theoretical,empirical, and related policy issues

Not only are school-age ethnic and racial minority children one of the fastest growing segments of the U.S. population, they are also one of the most vulnerable. Hispanic children in particular are representative of the at-risk status of minority populations, displaying a portrait of unrealized social, educational, and employment success. This paper addresses the background and history of U.S. social and educational policies as they relate to the Hispanic student. Recent empirical findings are presented which support the following: (a) the bilingual character of Hispanic children is not a linguistic, cognitive, or educational liability and, in fact, should be employed to promote academic achievement; (b) the culture of the Hispanic family and child are better understood with regard to socialization variables and the potential differences they produce when directly compared to Anglo culture; and (c) educational strategies for Hispanic students that respect and integrate students' social, psychological, and linguistic attributes serve students effectively.  相似文献

Expression of matrix metalloproteinase-9 in nasopharyngeal carcinoma and association with Epstein-Barr virus infection

Objective: To evaluate the expression of matrix metalloproteinase-9 (MMP9) in nasopharyngeal carcinoma and the association between MMP9 and Epstein-Barr virus infection. Methods: The MMP9 expression was studied by immunohistochemical analysis; and Epstein-Barr virus encoded small nuclear mRNA-1 (EBER-1) produced by in situ hybridization were examined in 41 nasopharyngeal carcinoma sections, and the relation between them, and the associations of MMP9 with clinical features were statistically analyzed. Results: Positive expression rate of MMP9 was 73.17%. The expression of MMP9 showed significant positive correlation with the expression of EBER- 1 (γ=0.483, P=0.001). There was significant association of MMP9 expression with lymph nodes metastasis and clinical stage (P＜0.001), non-significant association with age, gender, pathological classification and T classification. Conclusions: The highly pronounced expression of MMP9 is associated with cervical lymph nodes metastasis. Epstein-Barr virus can enhance NPC metastasis by up-regulating the expression of MMP9.  相似文献
