在群体性纠纷解决过程中, 群意表达易被集体意旨所表征而成为公开文本, 但群体成员个体表意的隐藏文本并不能有效转化为合意而被吸纳其中、 并在最终影响群体司法正义的实现. 既有群体司法虽通过直觉法中的情理因素涵摄以及法庭的非社会化给予响应, 但也由此造成了群体性司法诉讼效率与共识达成的现代化之殇. 德国针对私人投资者建立的首个示范性诉讼立法实践表明: 通过示范诉讼契约吸纳当事人诉讼处分合意,可改善群体司法对每一个当事人的诉讼权保障程度; 通过诉讼退出制, 可协调无法达成 "集体意旨" 的少数当事人另行起诉; 灵活运用包括胜诉酬金制在内的起诉激励, 也在一定程度上纾解了群体性诉讼巨型化的困局. 相似文献

This study found that mortality salience in TV news activated more hostile attitude toward the perpetrators and negative judgment on the immigration issue. Social group difference influenced news viewers’ immigration issue judgment, but did not affect their resultant hostility and perceived vulnerability. More negative attitudes emerged toward the immigration issue when immigrant perpetrators were portrayed negatively in the news. News viewers with exposure to mortality salience in TV news reported more negative toward immigrants. Exposure to mortality-related elements in TV news could lead to social conflicts that were viewed as a severe threat by U.S. government and policymakers. 相似文献

The founding of the Fā?imid caliphate across the southern Mediterranean, and then in Egypt, Syria and the ?ijāz at the turn of the fourth/tenth century, necessitated its negotiation with the ashrāf, those who claimed lineal descent from the Prophet Mu?ammad, and who by this time had gained significant influence as a social class based on their charismatic descent. While other dynastic powers fostered relationships with various members of the ashrāf, the Fā?imid–ashrāf dynamics were distinctive in that the Fā?imids legitimised their rule as Ismā?īlī Shī?ī imām-caliphs, based on their claim of descent from the Prophet Mu?ammad, and as the sole successors to his authority and leadership over the Islamic world. Relationship violence is a salient concern on college campuses today, and psychoeducational groups may be an appropriate prevention format. This article describes a study measuring the impact of college student participation in the HEART (Help End Abusive Relationships Today) program, a series of group sessions designed to increase knowledge and awareness of relationship violence. The present paper aims at proposing a structured methodology to evaluate the results of an academic training course addressed to postgraduate students. The evaluation process intends to identify the efficacy of an education course by means of a comparison between the general objectives and the results expected by the students. Since the evaluated aspects by the students, detected by means of questionnaires, are both quantitative and qualitative, the proposed methodology is based on the analytic hierarchy process (AHP). In order to facilitate the evaluation process, answers have been modelled by means of linguistic variables.
