责任保险中的直接诉讼,是指对被保险人享有责任请求权的第三人,可以对保险人直接提起诉讼。从国外立法来看,已有一些国家赋予了第三人直接诉讼的权利,但是由于对第三人所采取的保护程度和责任保险的种类不同,直接诉讼的条件也存在差异,这就不可避免的会产生法律冲突。目前已有一些国家和国际条约对以非合同责任为标的的责任保险中的直接诉讼规定了法律适用规则,但对以合同责任为标的的责任保险中的直接诉讼规定法律适用的则极为罕见,这是一个很大缺陷。直接诉讼应适用可选择的连接点,以利于更充分保护第三人的合法权益。  相似文献

教师是新课程改革顺利推进的决定性教育因素。“技术熟练者”教师角色形成的文化背景主要为现代知识观、行为主义心理学、泰勒的“目标模式”,其主要特征为教育理论知识缺乏,知识结构单一;教育智慧缺乏,实践能力差;质疑和批判精神缺乏,思想守旧、落后。“反思性实践家”的教师角色形成的文化背景主要为后现代知识观、认知主义心理学、批判理论,其主要特征为知识结构复杂,自我更新能力强;教育智慧充盈,实践能力强;质疑与批判精神丰厚,思想开放、进步。走向“反思性实践家”教师角色的条件主要有后现代文化转向和行动研究运用。  相似文献

Youth science expertise,environmental identity,and agency in climate action filmmaking

Abstract

The Green Ninja Film Academy (GENIE) is an interdisciplinary curriculum development project that examines the efficacy of combining climate science concepts and practices with digital storytelling for middle school youth. We present findings from iterative enactments of this design-based research project in 2017 (N?=?296) and 2018 (N?=?539). On average, youth increased scores on assessments of science content and practices while demonstrating competencies in filmmaking and science explanations. Further, an inverse correlation was seen between initial identification with the environment and change in environmental identification throughout the unit. Results suggest that integration of creative filmmaking into a climate science curriculum aligned to the Next Generation Science Standards can increase engagement and science proficiency particularly for youth who initially show less engagement in environmental science.  相似文献   

Umbrella action research projects as a mechanism for learning and teaching quality enhancement

ABSTRACT

Umbrella action research projects link together a number of small action research projects under a common organizational and thematic umbrella. This article provides an example of an umbrella action research project, which aimed for teaching quality enhancement. There are two mechanisms by which teaching quality can be enhanced. The first of these is through the improvements initiated in the small projects, which are normally conducted by teachers in the courses they teach. The second mechanism is that of the collective reflective discussions of the whole project team. The collective umbrella that over-arches the individual projects provides a mechanism for participants to collectively transform their understanding of the common thematic issue. There is, therefore, the possibility of an emancipatory transformation, so that the whole achieves more than the sum of the individual projects. This article substantiates the impact of umbrella action research projects by presenting case studies from an overall project that focused on online learning. The cases highlight our reflective discussions on promoting student engagement in online learning. They show how our collective understanding of engagement in online learning was advanced and some of the means tried in the small projects to encourage student engagement. As there is evidence of teaching quality enhancement through the umbrella action research project, we discuss the possibility of redirecting some of the resources currently devoted to quality assurance to quality enhancement through encouraging action research projects.  相似文献

This article reports the second stage of a study examining an academic partnership in which Bangladeshi doctoral students in a western university focus their research in the grounded context of Bangladesh and investigate the processes for change. After briefly outlining the previous published stage which examined the academic trade in higher education with developing countries, the article builds on the concept of fair academic trade to critically reflect on the development of a doctoral learning community, a publication project and three specific doctoral studies.
