试论"知情权"的几个疑难问题

“知情权”是民主与法治发展的产物，其地位越来越重要，但我国的法律制度对“知情权”却存在着规范供给缺乏、理论支持乏力的重大缺陷。文章试对传统“知情权”的概念进行重组，并提出知情权和知政权两项宪法性权利。进而，从知情权和知政权与隐私权冲突的角度进一步讨论，相应的提出解决冲突的原则、办法以及有关立法建议。  相似文献

网络隐私顾虑被认为是阻碍用户披露个人信息的重要影响因素并越来越受到学术界的重视。鉴于隐私是与情境相联系的多维、动态的概念，情境的变化会影响用户对隐私的理解，本文结合现实背景提出了电子商务环境下网络隐私顾虑的理论概念，在以往研究的基础上确定了网络隐私顾虑的构成维度，开发出初始的测量指标，然后通过3套独立的样本数据进行探索式因子分析、验证式因子分析和关联效度分析。结果表明量表具有良好的信度和效度，网络隐私顾虑由控制、收集、二次使用、错误、不当访问与补救5个维度和19个题项构成。  相似文献

In the analysis of the ethicalproblems of online research, there is much tobe learned from the work that has already beendone on research ethics in the socialsciences and the humanities. I discuss thestructure of norms in the Norwegian ethicalguidelines for research in the social scienceswith respect to their relevance for the ethicalissues of Internet research. A four-stepprocedure for the ethical evaluation ofresearch is suggested. I argue that eventhough, at one level, the problems of onlineresearch are very similar to those we find intraditional areas of social scientificresearch, there still are some issues that areunique to research online. A general model forthe analysis of privacy and data protection issuggested. This model is then used tocharacterize the special problems pertaining tothe protection of privacy in online contexts,and to argue that one cannot assume a simpledistinction between the private and the publicwhen researching in such contexts.  相似文献   

Privacy. An Intercultural Perspective

This paper deals with intercultural aspects of privacy, particularly with regard to differences between Japanese and Western conceptions. It starts with a reconstruction of the genealogy of Western subjectivity and human dignity as the basic assumptions underlying Western views on privacy. An analysis of the Western concept of informational privacy is presented. The Japanese topic of ‘‘denial of self” (Musi) as well as the concepts of Seken, Shakai and Ikai (as analyzed by the authors of the companion piece on privacy in Japan) give rise to intercultural comparisons. The paper addresses the question of privacy in cyberspace and mass media. Finally the question of freedom of speech is related to the Japanese concepts of Ohyake and Watakusi.  相似文献

Beyond individual-centric privacy: Information technology in social systems

In the public debate, social implications of information technology are mainly seen through the privacy lens. Impact assessments of information technology are also often limited to privacy impact assessments, which are focused on individual rights and well-being, as opposed to the social environment. In this article, I argue that this perspective is too narrow, in terms of understanding the complexity of the relation between information technology and society, as well as in terms of directions for managing this relation. I use systems theory to show that current approaches focus mostly on individual impact of information technology developments rather than their mediating role in society itself. I argue that this should be complemented by an analysis of impact on individuals (psychic systems) via co-construction of the environment (social system). I then take up the question of what the role of information technology in social systems would look like in terms of the social relations of trust and power, and how this can complement privacy in discussions on impacts of information technology.  相似文献
