| 摘 要： | 与人类最为密切的是婚姻家庭,婚姻家庭的变化以婚姻法来表征。从人类历史来察,人的主体性在婚姻家庭中得到了不断强化,而主体性是通过理性、自由、平等、公平等不同的视角来解读的。在当代中国社会转型的语境下,婚姻法司法解释三更是通过理性、自由、平等、公平来诠释主体性的内涵。

| Abstract: | Marriage and family,which is related closely to human,is characterized by the Marriage Law which reflects the changes of marriage and family.Human subjectivity is strengthened in the marriage and family from the perspective of human history.It is interpreted through rationality,freedom,equality,fairness and so on.The judicial interpretation III of the Marriage Law interprets the connotation of subjectivity in the process of social transformation in China. |
