| 摘 要： | 随着我国汽车保有量的增加,交通事故赔偿纠纷也逐年增多。道路交通事故责任主体确定的适当与否直接影响到受害人能否得到足额的赔偿,本文以道路交通事故责任主体的立法例比较作为切入点,对交通事故责任主体理论基础进行了论述,分析了我国现有交通事故责任主体法律规定的优缺点,并对即将生效的《侵权责任法》中交通事故责任主体的规定进行了评析,在此基础上对我国交通事故责任主体的立法完善提出了建议。

| Abstract: | With the rise of the number of automobiles,traffic accident compensation disputes are increasing year after year.The determination of liability subject in traffic accident directly affects whether the victims can get full amount of compensation.This paper,starting from the comparisons between the legislative cases of the liability subject in road traffic accidents,discusses the theoretical basis of ability subject in road traffic accidents,and analyses the advantages and weaknesses of the legal rules of the liability subject in traffic accidents.At last,it comments on the provisions about the liability subject in traffic accidents in Tort Liability Law that will come into force and raises suggestions to improve the law of liability subject in road traffic accidents. |
