| 摘 要： | 表达形式多样的民间文学艺术是艺术地域珍贵的文化遗产.国际社会大都通过积极立法寻求其生态保护延续.我国地方民间文学艺术遗产丰富,但面临原生环境受到蚕食,传承人老化且急剧减少,地域外人随意滥用民间文学艺术的问题.在没有出台专门国家性立法的形势下,各文化遗产地方纷纷出台地方的民族民间文学艺术保护条例、办法.从现有的司法判例及学理研究的中,通过对黑龙江民间文学艺术的地方考察,公法保护文化传承模式是一种有益的选择.

On the Inheritance and Legal Protection of Folk Literature and Art |

| Abstract: | Folk literature and art of various forms are precious cuhural heritage in the art domain. Most international communities seek to continue their ecological protection through positive legislation. China is rich in the heritage of local folk literature and art, but it is facing problems such as encroached primitive environment, the aging and sharply decreasing population of the inheritors, outsiders＇ abusing folk literature and art etc. In the absence of special national legislation, the local authorities of cultural heritage promulgate protective regulations and approaches on folk literature in succession. Based on the existing judicial precedent and scientific principle research and investigation on the folk literature and art of Heilongjiang, we come to the conclusion that the mode that public law is used to protect cultural inheritance is a good choice. |
