| 摘 要： | 非法证据的内容及其效力,一直是我国诉讼法学界研究的重要课题。非法证据就其外延来说有广义和狭义之分,对于非法证据,无论是广义还是狭义,都不应赋予其证据效力,成为定案根据。因此,在我国应严格确立排除规则。

The illegal evidence can be classified as broad-sensed and narrow-sensed, however ,it could by no means be granted evidence effect and be proof of verdict. So rules should be set up to have it strictly removed in our country. |
