| 摘 要： | 在知识产权产品的流通过程中,知识产权人的知识产权与产品所有人的物权会产生某种程度的冲突。这种冲突会影响到商品的自由流通和物的充分利用。这就需要在知识产权人的利益和物权人的利益之间寻找一个平衡点。知识产权领域的权利穷竭原则作为解决这一问题的方法,在著作权领域、专利权领域和商标权领域有不同的表现。

| Abstract: | Intellectual property and real right may come to conflict in the trade of intellectual products. The conflict may block the trading of commodities and may result in the failure of full use of the commodities. It is therefore essential to find a balance point between the rights of the intellectual property and the real product. Exhaustion doctrine in intellectual property law acts differently in the areas of copyright, patent and trademark respectively as a settlement to the similar problem. |
