| 摘 要： | 2009年5月1日生效的《旅行社条例》的最大突破点在于填补了我国之前的法律欠缺有关旅游合同专门的规定这一空白。这对于更加有效的旅游行政监管作用十分明显，对于旅游者权益保护也能起到相当的作用。但其中的局限在于虽然规定了旅游合同的必备条款，却没有规定在欠缺必备条款时旅行社的民事法律责任，由此造成无法实现对旅行社进行全面有效地监管。解决这一问题的办法是增加相应的民事责任条款。

| Abstract: | The Regulations for Travel Agencies came into force in May 1,2009,which is the first regulation in the industry in China,Its breakthrough lies in the availability of provisions for travel contracts.They will make the administrative supervision on tourist industry more effective and play an important role in protecting tourists' rights and interests.However,its limitations lie in the fact that though essential clauses for travel contract are provided,the civil responsibilities of travel agencies are not specifically identified if the clauses are absent in the travel contract.More need to be done so that tourists' rights and interests can be properly protected.Consequently,it is unlikely to conduct an overall effective supervision over travel agencies.The problem can not be resolved unless extra clauses for civil responsibilities are put into place.In addition,in view of the newly-emerging forms of traveling,tourism-oriented rules and regulations should be established by taking into account both regulating the travel market and leaving much space for various forms of travel contract. |
