| 摘 要： | 当今世界,人权与主权的关系理论颇多,这些理论虽有差异,但在本质上都是对传统主权至上原则的冲击和弱化。虽然有其积极意义,但其负面影响也是十分明显的。只有国际法真正建立在国际社会成员平等的基础之上,才能真正发挥其平衡人权与主权关系的积极作用。

| Abstract: | In today's world,the theories of the relationship between human rights and sovereignty are various.Although they are quiet different in many ways,they are the same in one aspect,ie.in essence all of them are against and weakening the traditional principle of the supremacy of sovereignty.Despite its positive significance,its negative effects are also apparent.Only a truly international law which is based on equality and balance of the members of the international community can really play its positive role to balance the relationship between human rights and sovereignty. |
