| 摘 要： | 行为犯与结果犯的区分在于结果犯构成要件的完全充足取决于物质性损害结果的实现；行为犯与危险犯的差异在于危险犯构成要件的完全充足不能脱离行为之后危险状态的判断，而且这种“危险状态”只能是具体危险状态；情节犯作为我国刑法特有的一种犯罪类型，它的情况比较复杂，从情节犯司法操作的具体情况分析，有的时候它可能表现为行为犯。

| Abstract: | The difference between the criminal of behavior and result is that the condition of the completion of the crime of result is decided by the result of material damage;the difference between the criminal of behavior and the dangerous criminal is that the completion of the dangerous criminal cannot depart the judgement of the dangerous state after the behavior, and the state is concret; as a special type in our country's criminal law, Plot criminal is very complex. On the basis of the analysis of the concret plot, sometimes it can be the criminal of behavior. |
