| 摘 要： | UCP500与ISP98均制定了有关转让的规则。二的共同点在于UCP500对于转让要件的规定与ISP98对于支款权利的转让要件的规定甚为相似。不同点具体表现为：ISP98中规定了因法律规定的转让，而UCP500则没有相应规定；UCP500与ISP98对信用证可转让的次数和比例的规定不同；转让是否需要获得转让银行或开证人／指定人的同意，UCP500与ISP98各有不同的规定；UCP500与ISP98关于转让对要求提交的单据的影响的规定不一样；UCP500规定了有关修改的特殊规则，而ISP98未作特殊规定。

| Abstract: | UCP500 and ISP98 are standard international practices which both make transfer rules. The common ground is that rules applying to transfer of drawing rights in ISP98 are similar to rules for transfer of commercial LCs in UCP500. Difference is predominant. Firstly ,ISP98 provides detailed rules on transfer by operation of law but there is no parallel provision in UCP500. Secondly ,UCP500 and ISP98 provide different rules on number of times and proportion of transfer. Thirdly, whether transfer need consent of transfer bank or issuer ,UCP500 and ISP98 have different provision. Fourthly, rules on effect of transfer on required documents in UCP500 differs from rules in ISP98. Finally, UCP500 provides special rule on revision but ISP98 hasn't parallel provision. |
