| 摘 要： | 电子商务突破了传统商业运作的模式,诞生新型法律关系并对我国传统的民商事法律规则构成直接冲突。我国应当立足于实践需求,整合国内已有法律资源并充分借鉴国际电子商务先进的立法经验,形成我国人大（常委会）立法模式、总分型法律架构及小体系式调整范围的电子商务立法。 |

| Abstract: | Electronic commerce breaks through the traditional business operation modes .And it brings about new types of legal relationship ,which conflicts with Chinese traditional civil and com-mercial laws and regulations directly .Based on the practical demand ,China should integrate the cur-rent domestic law resource and refer to the advanced legislative experience of international electronic commerce fully so as to formulate Chinese electronic commerce legislation ,which is characterized by the mode of legislation by NPC （Standing Committee） ,the structure of general and detailed laws and the scope of small systematic adjustment . |
