| 摘 要： | 道德过错被害人由于先前行为的道德责难性，受到不法侵害后，其权利救济陷入了困境。这主要表现为：一是自力救济的正义动机和正当手段的缺失；二是社会救助的道义支持、法律援助和物质救助的缺乏；三是公力救济的公权理性、法律效果和个人权利的缺位。

| Abstract: | The relieves for rights of victims of morality have been gotten into trouble atter tneir rights are infringed, because their previous actions are blamed in morality. It mainly includes three embodiments： first, there are lacks of just motives and legitimate ways to realize private relieves; second, there are absence of moral support, legal aid and material assistance to achieve social relieves; last, there are vacancy of reason of executives of public rights, legal effect and private rights to enforce public remedies. |
