| Abstract: | There is a setting of traditionally juristic cultural atmosphere, which attaches great importance to harmony and advocates non-litigation idea, in the Han Culture area of East Asia on delegating of Confucianism. Neither simple affirmation nor absolute denial can be made, when it comes to the non-litigation ideology of Confucianism. We can evaluate the Confucian non-litigation correctly, only when disclosing its essential content and its influence on the legal system, grasping the original historical background, and comparing with wide-litigation ideology in the West. |
