| 摘 要： | 本土资源对于法治建设至关重要,基础文化的不可塑造性、中国目前一定范围的“熟人社会”性以及法律的“民族精神”性决定了在我国进行法治建设的过程中必须注重对本土资源的吸收。中国法律文化中并不缺乏法治资源,不论在思想层面还是制度层面都有许多可供吸取的本土因素,对其进行认真考察,挖掘其背后的文化传承及现代价值,是中华文明步入法治路径的现实选择。

| Abstract: | Native resources play an important role in the construction of the law.Three factors,the nature of no-molding in national culture,"acquaintance society" in corresponding scope of Chinese present and "national spirit" of law,determined that we must pay much attention to absorb native resources in carrying through the construction of the law in process.Legal culture in China is not lack of legal resources.Not only has native resources for absorbing in ideology,but also has institution aspects.Being investigated seriously,and dug its behind cultural inheritance and modern value,it's a realistic choice for Chinese civilization tend towards to legal society. |
