| 摘 要： | 国际刑事责任一直是学术界和国际社会争论的热点问题。在国际法的发展中，对于自然人的国际刑事责任的理论已经逐渐明朗，但有关法人、组织和国家能否承担国际刑事责任的讨论，如能承担应该如何承担的讨论却愈来愈多。如果能从国际法理中和承担方式上论证法人和国家作为国际刑事责任的主体和理性，将会使这个热点的争论进一步明朗化。

| Abstract: | International criminal responsibility is the focus in the international society and law theory domain.With the developing of international law,International criminal responsibility of individuals are clear,but the argument of the international criminal responsibility of state and legal persons is more heated.If the reasonability of the international criminal responsibility of state could be proved in theory and ways of undertaking the criminal responsibility,this focus would be clearer. |
