| 摘 要： | 诚信是一种非常复杂的社会现象.基于不同的理论视角,诚信将呈现出不同的内涵和规定性.法律诚信是以相应的道德诚信作为基础和依托,道德诚信必须以相应的法律诚信为保障.诚信是法治的主要道德取向所在,缺乏诚信这一道德隐喻的法治不能称之为良性法治.法治社会既有赖于道德诚信的内在调适,更需要法律诚信的外在规制.

| Abstract: | Good faith, as a complicated social phenomenon, would present different connotations and provisions from different perspectives. Legal good faith is based on moral good faith, while moral good faith is guaranteed by legal good faith. Good faith is the main moral orientation of rule of law. so a rule of law lacking good faith is not a good one. A legal community needs not only internal moral adjustment but also external restriction of legal good faith. |
