| 摘 要： | 本文在论述不同类型合同解除的条件、程序以及解除后法律后果的承担中，对于合同解除中的若干法律问题如何理解以正确地行使合同解除权，对于合同约定解除的合理期限正确界定，合同解除溯及力问题以及合同解除能否要求赔偿和赔偿的范围问题，提出了一些见解。

| Abstract: | The paper discusses conditions,procedure,and legal consequences of rescinding different contracts.Then the writer gives some pinions on how to understand several legal problems of rescinding contract in order to exercise rights of rescinding contract properly,on defining reasonable deadline when contract is rescinded,on its tracing date and on whether the compensation can be required after rescinding contract and the compensation scope. |
