| 摘 要： | 公平和正义是法治的生命。在现代法治国家中,为了确保公平和正义的实现,人们要求法官对其判决必须给予充分的论证。因此,起源于亚里士多德修辞术的修辞论证直到今天的法律论证也由此越来越被人们所重视。如今,法律论证已在法庭审判中承担着重要的角色。作为法律论证始祖的亚里士多德,在二千多年前就为我们今天研究法律论证提供了许多重要启示。
