| 摘 要： | “天人合一”思想是中国儒家天命观的集中体现,也是中国传统法律文化的哲学基石。受“天人合一”思想中尊天敬天观念、“民本”现念、重合轻分观念的影响,中国古代法律凸现出与之相应的三大基本特征,即宗教化、伦理化、和谐化。中国古代哲法关系对构建当代法哲学体系,不乏启迪意义。

| Abstract: | The idea of "Universe and Man Existing in Harmony" mainly reflects ancient Chinese Confucican point of view of "the mandate of heaven" , besides, it is the philosophic base of traditional Chinese culture of law. Influenced by the ideas of respecting heaven, the people being a nation's base, and preferring unity to division, which belong to the idea of "Universe and Man Existing in Harmony", ancient Chinese law got three correspondent essential features: religiousness, ethicizings , and harmoniousness.The ancient relationship between philosophy and law is helpful for us to construct the current system of law and philosophy. |
