| 摘 要： | 学校是专门从事教育的社会公益性组织。学校对未成年学生的监护责任是一种法定的监护义务，其监护的时间和内容是特定的和有限的，学校对被监护人所负监护义务的归责原则是过错责任原则，当在校未成年人的人身权益受到损害，只有在学校有过错的情况下，才应负损害赔偿责任，而未成年人的亲属监护人在大多数场合要负无过错责任。本文试通过对学校的性质、学校与学生的关系、在校学生人身损害赔偿的归责原则的论述，提出切实可行的措施来保护未成年人和学校的合法权益。

| Abstract: | The school is one social commonweal organization of engaging in the education specially. The custody responsibility of a school to the young person at school is one kind of legal custody incumbency and the custody time and content is given and limited. The responsibility principle through which the school should shoulder the custody incumbency to the person under guardianship is the mistake responsibility principle. When right of the young person at school is hurt, only under the situation that the school has made the mistake, the school just shoulders the compensation for personal injury but their relational guardian will shoulder no mistake responsibility on most occasions. In this article, through the discussion on the quality of the school, the relation between the school and students and the responsibility principle of the compensation for personal injury, the authors have brought forward the effective measures to protect the lawful rights and interests of the young person at school and the school. |
