| 摘 要： | 权力和权利都是主体对客体的影响力，所不同的是权利是一种对称性影响力，而权力则是一种非对称性影响力。“权力来源于权利”是一种契约论的分析，其普遍适用性是值得商榷的；但这种契约论分析的宣扬，对于权利保障、公民社会的发展壮大以及民主宪政建设有重要促进意义。由于在特定环境下权利和权力之间可以相互转化，同时使用这两种手段的不同主体在利益实现中的博弈，使得权利和权力之间可以形成相互影响和相互制约的关系。

| Abstract: | Both power and right are a kind of subject-to-object influence, while right is symmetry influence but power a-symmetry. Their relationship of“power sources from right”, which is an analysis of Contract Theory, has uncertain general appli-cability. However, it is still of great significance in promoting “right security”, “civil society” and “democratic constitutional construction”. This paper concludes that, because these two can be transferred under certain circumstances, we should balance them among different subjects and make them form mutually-influential and interacting relationship. |
