| 摘 要： | 陪审制度作为我国社会主义民主法制的一个重要组成部分曾经起过一定的历史作用。但近年来陪审制度在我国呈现出淡化的趋势。虽然现行法律并没有否定陪审制度,陪审制度在现实中也依然存在着,但不容忽视的是,陪审在中国现行审判制度中所具有的作用几乎到了被忽略的地步。在司法实践中,实行陪审的案件数量极少,许多地方法院审理一审案件时往往不设陪审员。理论界对陪审制度的存废问题亦莫衷一是,然则陪审制度依然有其存在的合理性一面。因而,改革与完善我国的陪审制度才是求真务实的做法。

| Abstract: | As the important part of socialist democracy and legal system in our country,the jury system played a very important role.But the jury system seems to be downplayed in our country in recent years. Although the current law doesnot negates jurors and jurors still exists in true-life,its role has been undercut and almost ignored in judicatory practice,thequantity of the case tried by the jury system has become very little.Meanwhile,many district courts have not taken on jurors.The attitude of keeping or giving up jury system differs in the theoretical circle,but jury system still has its reason to exist.As a result,reform is a better way of treating this topic. |
