| 摘 要： | 我国《刑法》新罪名司法解释中的“非国家工作人员受贿罪”罪名存在不符合构成要件、不当扩大犯罪主体外延、没有体现犯罪本质和与刑法罪名体系不协调的问题，值得商榷。我国《刑法》应当建立公务受贿罪、业务受贿罪和商业受贿罪的贿赂犯罪体系，并且重定贿赂犯罪的罪名，分别定为国家工作人员受贿罪、公司、企业或者其他单位人员受贿罪和商业受贿罪。

| Abstract: | There are some questions in the new judicial interpretation of accusation about non-governmental staff bribery crimes,such as falling short of special constitutive elements of crime,inappropriately widening the extension of subject of crime,not incarnating the essence of bribery crimes and inconsistent with the system of accusation.We should establish a system of bribery crimes including public office bribery crimes,operation bribery crimes and commercial bribery crimes.And we should redefine the accusation of bribery crimes respectively as government staff bribery crimes,company,enterprise or else units staff bribery crimes and commercial bribery crimes. |
