| 摘 要： | 修正后的《婚姻法》增设的离婚损害赔偿制度填补了我国婚姻立法的空白。如何完善这一制度为法学理论界所关注。文章就离婚损害赔偿的范围、离婚损害赔偿的责任主体等问题提出了立法建议。

| Abstract: | The newly-established compensation system for divorce damage of the revised "Marriage Law" has filled the gaps in marriage legislation of China.How to perfect this system is concerned by the theory circle of law science.This paper makes legislation suggestions about the range of compensation for divorce damage,the responsibility subject of compensation for divorce damage and other questions. |
