| 摘 要： | 物权公信力原则是物权变动的基本规则且为善意取得制度的理论基础,其适用受到严格的限制,表见物权和真实物权的背离是公信力原则适用的基本逻辑前提,而能够主张公信力原则保护的,限于基于法律行为而取得物权的善意取得人,表见权利人则并不受其保护。此外,公信力原则只为善意者的利益而存在,不关涉其不利益,且与表见权利本身紧密相关。

| Abstract: | The principle of the indication validity of property publication is a basic rule of the transference of real right and it is the theoretic basis of bona fide acquisition,but there are many strict limits to it's use,it means that it must possess certain requirements.The existing of the right indicated by fake indication and real right is the basic logic premises,and the person who can claim for protection of indication validity is only the one who acquired real right by juristic act and also is bona fide,otherwise the owner of the right indicated by fake indication can't claim.At last,the principle of the indication validity is only existing for the interests of the party who is bona fide,and it is connected with the right indicated by fake indication. |
