| 摘 要： | 摘要：投资客体是指主体在投资活动中，其权利和义务所共同指向的对象。投资客体的法律性质，是指投资客体在法律上区别于其他经济行为客体的本质属性。投资客体包括投资财产客体和投资成果客体。投资财产客体主要包括，全权投资财产和限权投资财产。从投资财产的接受方来看，凡符合其使用价值和价值要求的财产，在法律允许其转让的条件下都可以成为投资财产客体。从投资主体的角度看，只有投资主体享有法定处置权和收益分配权的财产才能成为投资财产。投资成果客体主要包括，投资活动所形成的全权资产和限权资产。作为投资成果客体，它必须是各种形式的资产，必须是投资活动形成的资产，投资主体必须享有该资产的使用权和收益分配权。按照投资财产客体的经济法律性质和存在的物质形态，可分为货币财产、非货币有形财产和非货币无形财产。按照投资成果客体的经济与法律性质及其物质形态’，可以将其分为产业资产和金融资产。债权资产是重要的投资成果客体。

| Abstract: | Investment object is the object that the right and obligation of a subject jointly refer to while the subject involves in an investment activity. The characteristics of investment objects mean the innate attributes which differ distinctively from other objects of economic activities in law. Investment objects include those of property investment and those of achievement investment. The former mainly includes unlimited property and limited property. From the viewpoint of the receiver of the investment property, those property conforming to its value of usage and requirement can all become the objects of investment, if legally allowed to transfer the ownership. From the viewpoint of the investment subject, only the property which the investment subject can, by law, enjoy the rights of disposition and earning profit can become investment property. The object of achievement investment mainly includes unlimited assets and limited assets obtained from investment activities. The object of achievement investment should be assets of various forms and obtained from investment activities. The subject of investment should enjoy the rights of usage, earning profits and distribution of the asset. In accordance with the economic legal characteristics of the objects of investment property and the existing physical forms, the objects of investment property can be classified as currency assets, non-currency physical assets and non-currency invisible assets. In accordance with the economic legal characteristics of the objects of achievement investment and their physical forms, the objects of investment property can be classified as industrial assets and monetary and financial assets. Assets of obligation is an important object of achievement investment. |
