| 摘 要： | 企业专利诉讼不再仅仅是法律问题,也是专利资源与企业竞争战略相结合的产物.在分析专利战略和企业专利诉讼行为的基础上,针对企业间专利诉讼逐渐呈现出多样化的趋势,本文提出了专利诉讼行为的交易、掠夺、投资和防御四种模式,并进一步对四种模式的内涵、专利战略的运用、诉讼资源获取、资源集中程度、议价优势等方面进行比较分析,探索了企业专利诉讼模式与专利战略之间相互作用相互影响的动态关联性,为我国企业在国内外市场竞争中有效解决专利纠纷冲突、预防专利诉讼风险提供理论指导与方法支撑.
