| 摘 要： | ＂亲亲相隐＂是儒家思想中很重要的一个面相,从传统律法的历史演变这一角度来讨论＂亲亲相隐＂在司法实践中的作用,可在辨清这一历史线索的基础上对其思想价值做出分析与论证。＂亲亲相隐＂表达了儒家极富生活智慧的哲思,而由其所凸显的法律与人情的冲突也并非不可调和,至于说＂亲亲相隐＂导致腐败的问题则更是捕风捉影的无稽之谈。

| Abstract: | This essay first analyzes the employment of ＂mutual concealment of offenses among the kin＂,an important part of Confucianism,in juridical practice from a perspective of historical development of traditional laws and makes a further analysis and demonstration of its theoretical values.The author believes that ＂mutual concealment of offenses among the kin＂ shows the life wisdom of Confucians and the clash between laws and relationship is not irreconcilable.Besides,it doesn＇t make any sense that ＂mutual concealment of offenses among the kin＂ may lead to corruption. |
