| 摘 要： | 学校章程首先是一个法律问题。章程的制定相当于立法。从法理学的视角，借鉴立法的知识，章程制定程序包括制定步骤和主体两个方面。首先，探讨了高校章程制定程序的理论。其次，指出我国目前高校章程制定程序实践中存在制定主体不统一、步骤不全面的问题以及建议通过立法予以规范。

| Abstract: | Universities＇ statutes initially mean a legal matter, and the formulation of universities＇ statutes are equal to legislation.From the angle of jurisprudence and using the konowledge of legislaiton for reference ,the formulaiton procedures of statutes include two aspects： steps of formulation and Subjuect of formulation.Firstly, this paper has discussed the theory concerning the formulation procedures of universities＇s statutes ;Secondly, this paper has pointed out the disunity of formulation subjects in the practice of the formulaiton procedures of universities＇s statutes in china at present ,and the issue of incomPlete steps and has commended to standardize the mentioned issues through legislaiton. |
