| 摘 要： | 环境价值观是环境法目的理念的基础和出发点。传统的“人类利益中心”环境价值观引致了日益严重的环境危机 ,而脱胎于生态伦理学的“生态利益中心”环境价值观作为一种道德主义理想 ,在法律层面上遭遇到困境。“可持续发展观”以公平、公正为基本价值观 ,以追求人与自然的和谐为价值目标 ,是生态道德法则上升为法律规范的唯一理性选择。由此 ,环境立法的终极目的应该是 ,以可持续发展价值观为导向 ,实现人与自然的和谐发展 ,保障人类利益和生态利益。

On the Ultimate Aim of Environmental Legislation--On the Value of Sustainable Development |

| Abstract: | The value of environment is the basis and starting point of the idea of environmental law.The traditional value,which takes human interests as center of all,has incurred more and more serious environmental crises.And the another value which takes ecological interests as center of all,has confronted with hot potato in the field of jurisprudence.However,the value of sustainable development,which takes equity and justness as its basic value,goes in for the harmony between nature and human.So the ultimate aim of environmental legislations should take the value of sustainable environment as its direction so as to realize the harmony between nature and human and safeguard both the interests of nature and human. |
