| 摘 要： | 醉驾入刑的规定,使酒后驾驶的违法成本大大提高,因而,越来越多的人选择酒后代驾。然而目前我国法律规范对酒后代驾的规制并不完善,导致酒后代驾纠纷频发。把现实生活中的酒后代驾合同进行分类,阐述不同类型的酒后代驾合同的性质、发生交通事故造成车主或第三人利益受损时民事责任的承担,为解决酒后代驾纠纷提供借鉴。

| Abstract: | Sine drunk driving was taken into the provisions of punishment in order to reduce the illegal cost greatly, therefore , more and more people choose a designated driver for drinker, but at present there is no law to control the designated driver for drink- er industry in China, as a result , the designated driver for drinker results in frequently disputes in real life. This paper classify the designated driver for drinker contract in our life, exptain the nature of the contract, and how to bear the civil capacity when the acci- dent happened which cause loss to owners of the car or the third party .The analysis provides some suggestions to solve the disputes of designated driver for drinker. |
