| 摘 要： | 乌拉圭回合谈判将TRIPS协定纳入其议题,是将传统的知识产权法引进国际经济法,确立调整知识产权领域的革新者与后进者之间关系的最低标准。文章在研究TRIPS协定规定的专利标准的同时,又分析了专利保护中存在的主要问题;然后从经济学的角度分析了专利制度存在的意义;最后研究分析了我国专利法与TRIPS协定的差距。

| Abstract: | Uruguay Round includes the topic of TRIPS protocol,which introduces the traditional intellectual property right law to the international economic law,minimums standard of the relationship between the persons who establish innovator and the less advanced who adjust the intellectual property right field.The subject matter in patent protection while studying patent standard stipulated in TRIPS protocol is discussed in the paper,with the analysis of the meaning in which the patent system exists in terms of economics. |
