| 摘 要： | 20世纪80年代以来,大陆学界对中国法制史的研究成果颇丰,但受传统成说影响,学界对五代十国法制史关注不够、研究成果不多。既有成果大致可分三类,即制度史类著述、中国法制史教科书和著述、直接研究五代十国法制史的著述。这三类成果对五代十国法制史的研究不尽客观、全面。学界今后对五代十国法制史的研究,起码应有两个转变:一是在学术观念层面,由五代十国"滥刑"或"无法"向唐宋变革期法制传承演变转变;二是引入法律的实践历史研究方法,重视司法案例深度分析。两者结合方能加强这个领域的系统研究。

| Abstract: | The mainland academic circles have achieved rich results on Chinese law history since 1980s. But the academic circles have paid insufficient attention to the law history of Five Dynasties period,and there have been few research results. The reason was that the impact of old opinions. The results have been roughly classified into three categories： system history writings,textbooks or writings about Chinese law history,writings directly on law history of Five Dynasties period. The three kinds of results on law history of Five Dynasties period aren＇t objective and comprehensive. In the future,the academic research on law history of Five Dynasties period should have at least two changes： one is the change of academic concept from ＂excessive punishment＂or ＂lawless＂in Five Dynasties period to legal inheritance and evolution in Tang and Song Dynasties period; the other is the application of the method of law history of practice and attention to in-depth analysis of judicial cases. Combination of the two points can strengthen systematic research in this field. |
