| 摘 要： | 目前我国对探矿权采矿权属性颇有争论，且观点不一。解决争论的本质在于从法律上将探矿权及采矿权的法律属性加以准确界定。本文从以下角度对探矿权采矿权进行阐释并说明其特性，其一是不能将性质不同的探矿权采矿权茏统地统括在矿业权概念中；其二是应该对矿产资源与矿产品从法律上加以区分，厘清矿产资源所有权与用益物权的法律关系；其三是要对用益物权之内容——收益与处分予以合理解释。使得采矿权的应有内涵不会与传统意义上用益物权的内容发生错位。这就需要打破就概念进行分析的逻辑结构，从探矿权采矿权本身出发，看其到底蕴含着怎样的利益结构，进而对探矿权采矿权进行准确定位。

| Abstract: | At present there are disputes on natures of mineral exploration right and mining right and ideas differ. The key to settle the disagreements is a clear defining of natures of exploration right and mining right in law.In this essay, the following aspects about exploration and mining rights are explained and their features aresketched. One, exploration and mining rights of different natures can hardly been roughly labeled as mineral indus-trial right; two, mineral resources and mineral products should be identified in law entries so that the relationshipbetween mineral resource ownership and real right of usufruct can be clarified;three, reasonable explanation on thecontents of real right of usufruct benefits and distribution should be made so that there will be no misplacement of divine nature of exploration right and traditional real right of usufruct. In order to achieve all of theseand an accurate orientation of exploration and mining rights, the logic that analysis is made on the basis of conceptsneed to be broke and the starting point should be the target rights themselves. |
