| 摘 要： | 实用艺术作品包括实用美术作品和工业品外观设计两部分。"专利法所称的外观设计,是指对产品的形状、图案、色彩或者其结合所做出的富于美感并适于工业上应用的新设计。"外观设计作为一类独立的受专利法保护的客体,具有发明专利、实用新型专利、注册商标以及著作权都无法替代的作用。随着商品经济的发展,法律对外观设计专利权的保护日益增强。

| Abstract: | The practical artistic works include the design of practical fine arts and exterior design of industrial products.The exterior design in patent right refers to the disgn of the products' shape,picture,color and the relevent aesthetic new designs applicable to industry.The exterior design,which is independant and protected by patent right,posesses the inventive patent,practical new patent,trade mark and copyright.With the development of commercial economy,the law is increasingly enhancing the protection of the patent right of the exterior design. |
