| 摘 要： | 我国于2001年10月对《商标法》进行了修改，使之基本符合了TRIPS协议的要求，进一步完善了我国的商标法律制度。但是，新商标法与TRIPS协议相比还存在一定的差距，仍有许多问题有待于进一步研究解决。文章拟对新商标法中存在的不足进行分析，并提出完善商标立法的几点建议。

| Abstract: | The Chinese Trademark Law has been revised in October 2001 to make it agree to TRIPS improving China's trademark law system.However,there is still disparity,and many problems to be solved.With the analysis on the shortcomings in the new trademark law,several suggestions are proposed to better the law. |
