| 摘 要： | 软件权即软件著作权，是软件开发者及其合法继受人对其创作的软件作品依法所享有的专有权利。软件权侵权原因多种多样。从软件作品市场化过程中所涉及的权利义务主体看，软件权侵权利主体、经营者、消费者、侵权者及权利管理者的保护者等因素所致。技术保护、行政管理和司法救济是软件权的三种主要保护方式，并且每一种方式都各有利弊，都会导致权利人的抉择困惑。因此，要切实做到防范软件权侵权，保护软件权人的合法权益，就应该从

| Abstract: | Right of software is also Copyright of software,it is an excusive right that software's author, his heirs and alienee took legally basis on his inventing software works.There are many reasons of infringing copyright of software.Seeing from the different subjects of rights and obligations which involving in the course of software works running towards the market,reasons of infringing copyright of software include subject of right,software operators,consumers,persons of infringing copyright of software,governors and protectors,etc.Its ways of protection included technological,administrative and judicial protection,and in every way of protection there are both advantages and disadvantages that will cause some perplexities when the obligee choose which of three ways of protection.Therefore,we must start on the perfect of ways of protection,juristic system,etc.,if we entirely keep away the phenomenon of infringing copyright of software,and we can really protect the obligees legal rights. |
