| 摘 要： | 商业秘密保护立法是现代技术经济发展的本能需求,而我国目前的法律状况与之极不相符,法律过于分散,立法原则尚未确立,保护主体不明确,处罚力度不够,所以,亟需建立商业秘密保护法律制度。

| Abstract: | The legal protection of business secrets is a natural outcome of development of modern technical economics.However,the legislative situation in China today is far from satisfying.The law is discarded largely,the principle is not determined yet,the protection is not identified and the punishment is not effective,so the establishment of the legal protection of business secrets is urgent. |
