| 摘 要： | 正义意为公正、公平,它包含“得所应得”、“一视同仁”等原则.孔子表达正义的核心范畴为“义”、“道”,“义”较“正义”内涵更丰、应用更广、实践难度更大.孔子认为,“道”是正义的哲学根基、价值本体,正义与仁爱是实现“道”的基本原则、手段,分别体现“道”对秩序与和谐的价值要求.仁爱在道德层次上高于正义,对正义起着引导、推动作用,正义则对仁爱发挥调节功能,二者须相辅为用.孔子正义观的提出有其现实背景,对我们当下和谐社会建设具有启导意义.

| Abstract: | Justice means impartiality or fairness,which contains the priciples of"to get what he deserves"and "to treat everyone equally".Core category by which Confucius expressed justice is "Righteousness" and "Tao"."Righteousness" has more abundant content,wider use,more difficult practice than justice.It’s believed by Confucius that "Tao" is philosophical foundation and value ontology of justice which constitutes basic priciples of "Tao" with benevolence,and respectively reflect the values of order and harmony needed by "Tao".Benevolence higher than justice in morality can lead and promote justice which can also regulate benevolence.Confucius’ theory of justice put forward and based on realistic backgroud will have an enlightening meaning to constructing our harmonious society. |
