| 摘 要： | “少杀、慎杀,可杀可不杀的坚决不杀”原则对死刑裁量没有限制作用,杀人要准、适用死刑要考虑社会影响的原则难以限制死刑的适用,纵向稳定、横向平衡原则可能导致死刑的滥用。为了有效限制死刑的适用,应确立“严格限制的报应刑原则”、“必须考虑的预防刑原则”、“犯罪事实和犯罪人被全面考量原则”以及“一切合理怀疑被排除原则”。

| Abstract: | The current principles of "killing few, killing cautiously and killing none" measuring the death penalty, have little effect on restricting the application of death penalty. The principleto kill the one who should be kiued and take into consideration of application to the death penalty can't restrict the application of the death penalty. The principle of file stability and crosswise balance may leod to the abuse of death penalty. Therefore the article suggests four different principles on the measurement of death penalty in order to reduce the application of death. |
